The University of
Real Estate Investing LLC ("UREI") website provides visitors with a single site
from which to learn various aspects of the real estate investing business. This
Agreement contains the terms and conditions (the "Terms of Use") that apply to
your use of uofrei.com (the "Website"). Please
review these Terms of Use, and if you do not agree to be bound by them, do not
use the Website. The information posted on the Website is owned by or licensed to UREI and cannot be reproduced or otherwise used by you without the owner's permission. Where you are given the opportunity to post information or pictures to the Website for viewing by others, be sure that such information or pictures are not inaccurate, unlawful or infringing upon the rights of others. Please don't interfere with other members' privacy expectations by scraping or otherwise using their personal information, our code, etc. for your own (or anyone else's) commercial or non-commercial purposes. Don't give your ID and/or password to another person - you will be responsible for any actions of anyone to whom you give your ID and/or password, plus, whoever uses your information will be identified as you on the Website and your name will be on everything that person posts. In the end, all
personal and business decisions are yours and yours alone. Terms of Use If you use any service on the Website, you will be deemed to have accepted the following terms: 1. Passwords You will be issued a user ID and password (which you may subsequently change) to access the Website services. You agree not to provide your user ID or password or to otherwise grant access to this Website to any other person and, if you do so in violation of this Agreement, you will be held responsible for: (a) providing access to the Website in violation of the terms of this Agreement, (b) the online conduct of such person; (c) monitoring such person's access to and use of the Website; and (d) the consequences of any use of the Website by such person. If you make a business decision to allow a direct employee such as your personal assistant or office manager in your real estate business to access the Website to conduct business on your behalf, all conduct and use of the Website by such employee will be attributed to you and you will be held responsible for their compliance with the terms and conditions of use of the Website and any services or products provided through the Website. 2. Privacy Please review our Privacy Policy, which is a part of this Terms Of Use and describes how UREI handles any personally identifying information collected from visitors to this Website. 3. Trademarks All trademarks, service marks and trade names used on the Website are the property of UREI or their respective owners, and may not be copied, downloaded or otherwise exploited without the permission of UREI or the owner of such trademark, service mark or trade name. UREI, University of Real Estate Investing and the UREI Seal are trademarks of UREI. You may not use UREI trademarks in connection with any product or service that does not belong to us, nor in any manner that is likely to cause confusion among users about whether we are the source, sponsor or endorser of the product or service, nor in any manner that disparages or discredits us. You may not use metatags or any other "hidden text" that incorporates the UREI trademarks or our name without our express written consent. 4. Website Content; Copyright; Infringement This Website is owned and operated by UREI and contains documents, data, text, graphics, code, software and other materials ("Website Content") supplied and owned by UREI and other sources. The Website Content is protected by copyright, trademark and other applicable laws, and the owners reserve all rights and do not transfer title to any Website Content to you. Provided you keep intact all copyright and other proprietary notices, you may print, in hard copy, portions of the Website Content for your own personal, non-commercial use. You are not permitted to modify, copy, reproduce, republish, post, transmit, distribute or publicly display the Website Content in any way, or to commercialize any Website Content, or to prepare derivative works based on the Website Content. Provided, if you request and receive express prior written consent from UREI to use any Website Content for a specific purpose, all such use must conform to the terms of the written consent. Using screen scrapers, robots, crawlers or other means to extract Website Content or data in bulk from this Website or its related applications for any purpose is strictly prohibited. UREI reserves the right to cancel your registration and membership immediately, to terminate your license to use the Website and to prosecute to the fullest extent of the law if a violation of these terms occurs or if it determines in its sole and absolute discretion that you are involved in infringing activity, including alleged acts of first-time or repeat infringement, regardless of whether the material or activity is ultimately determined to be infringing. UREI reserves the right to take any action reasonably necessary upon notice of a potential claim to mitigate its exposure to liability for contributory or vicarious infringement, defamation or other claims arising from, relating to or based upon any content you provide to the Website, including but not limited to removing such content and/or turning off your access to the Website or portions thereof. Such action will not be considered a breach or default by UREI. You acknowledge that any content, ideas or information ("Content") you may provide to UREI becomes the property of UREI, including all copyright, without reservations, and you waive in favor of the foregoing any and all moral rights in such Content. By submitting Content to UREI, you automatically warrant that you have the full right and authority to submit such Content, and that none of such Content is subject to any copyright or other proprietary right of a third party. The owners and operators of UREI reserve the right to not publish, or to remove any Content that they deem in their sole discretion, to be inappropriate for UREI for any reason whatsoever. 6. Links; Frames You may link to the home page of the UREI Website as long as the link does not cast us in a false or misleading light. Links to Other Websites This Website may contain links to websites other than uofrei.org. This User Agreement and the Privacy Notice apply only to the UREI Website and not to other websites. Be sure to read the user agreements and privacy policies that govern your use of these other websites, as UREI is not responsible for such websites or the information, advertising claims, products or services of the website owner or operator. Refund Policy If you wish to apply for a refund of any product purchased via this Website it must be done within 1-30 days of purchase date. Refund requests later than 30 days will not be accepted. To apply, contact our Customer Service team at 866-908-UREI (8734) with your full name, the name of the product that you purchased and the reason for the refund. A $50.00 fee will be retained for each refunded item. No credit card information required for refund* - we will reverse the transaction on same card as original purchase. The information contained in this Refund Policy supersedes any verbal or other written information that you or anyone may receive regarding this policy. Limitation of Claims You must bring any action on any claim against UREI within one (1) year following the date the claim first accrued, or your claim shall be deemed waived. 8. Warranty Disclaimer THE UREI WEBSITE, WEBSITE CONTENT AND FUNCTIONALITY PROVIDED IN CONNECTION WITH THIS WEBSITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. material posted or otherwise provided by you that is illegal or infringes any
copyright, trademark, trade secret, trade dress, patent or other intellectual
property right of any person or defames any person or violates their rights of
publicity or privacy, (b) any misrepresentation made by you in connection with
your use of the Website or Website Content; (c) your entry of false, misleading,
fraudulent, discriminatory or defamatory information into, or your omission of
material information from, a database, form, web board or other discussion forum
provided through the Website; (c) any non-compliance by you with these Terms;
and (d) claims brought by third parties arising from or related to your access
or use of the Website and/or Website Content. You may terminate this Agreement by discontinuing your use of the Website. UREI may terminate this Agreement and the license rights granted hereunder for any reason or no reason, with or without notice. 12. Modification UREI reserves the
right to amend this Agreement, with such amendments becoming effective upon
posting them on the Website. Your continued use of the Website shall be deemed
to indicate your acceptance of any such amendments. UREI also reserves the right
to modify, add or discontinue any functionality, content or feature of the
Website at any time without notice to you. This Website is controlled and operated by UREI from its offices within the state of Florida, United States of America. UREI makes no representation that the Website Content is appropriate or available for use outside the United States. Those who choose to access this Website from outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable. Software from this Website is further subject to United States export controls. No software from this Website may be downloaded or otherwise exported or re-exported (A) into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other country to which the U.S. has embargoed goods, or (B) to anyone on the U.S. Treasury Department list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders. Choice of Law; Dispute Resolution This Agreement will be governed by and construed in accordance with the laws of the State of Florida without giving effect to any principles of conflicts of law, and venue will be in Orlando, Florida with each party agreeing not to contest or seek to change venue. 15. Miscellaneous You may not assign any of your rights, obligations or privileges hereunder without the prior written consent of UREI. Any assignment other than as provided for in this section shall be null and void. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This Agreement and any posted operating rules constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter. No waiver by either party of any breach or default hereunder shall be deemed a waiver of any subsequent breach or default. The titles and subtitles used in this Agreement are used for convenience only and are not to be considered in construing or interpreting this Agreement. Sections 4, 8, 9, 10, 14 and 15 will survive termination of this Agreement. |
